The former cop from Minneapolis, Derek Chauvin, has finally spoken up to announce how he refuses to testify at his murder trial of George Floyd.
Chauvin briefly addressed the court during the early hours of Thursday where he specifically mentioned how he would not testify during the ongoing trial. On the other hand, the defense attorney for the case, Eric Nelson spoke about how Chauvin just reached the bold decision recently, adding how he would move forward and invoke the 5th Amendment.
Meanwhile, Judge Peter Cahill reportedly accepted Chauvin’s decision, claiming how he would now instruct the jury to avoid reading Derek Chauvin’s silence as one of the indications that hinted towards his guilt.
Local media outlets now report how Judge Cahill then soon went forward to deny at the 11th hour a bid that revolved around allowing the entrance of new evidence. This evidence was related to the levels of carbon monoxide present in George Floyd’s blood, during the time of his death.
In the same way, the judge mentioned how he would now declare a mistrial in the case when the state presented some more new evidence, despite the rebuttal.
After a swift recess into the case, Nelson went forward and announced how the defense did not have any more witnesses, resting its case quite early.
The subject of carbon monoxide levels in Floyd’s blood had to do with how the deceased could have inhaled the exhaust fumes while being in a pinned downstate. This was a position that was awfully close to the police squad car.
Just recently, a pathologist confirmed how strongly he felt that Floyd’s death resulted due to his underlying heart conditions and not due to excessive force by Derek Chauvin.point 464 |
Moreover, he went on to add how Floyd’s death occurred as a result of a number of factors and not just excessive force due to the kneeling down of the officer upon his neck.point 146 | 1
